Terms of Service Agreement
Garage Door Store, LLC (“GDS”) operates this website: https://newgaragedoorstore.com (the “Site”). Throughout the Site, the terms “we”, “us” and “our” refer to GDS. GDS and the Site are used interchangeably throughout this Agreement insofar as the Terms of Service set forth herein apply with equal force to users of GDS and users of the Site. By agreeing to the terms herein and purchasing any product from GDS – or following any instructions or recommendations that the user may find on the Site – the user agrees to all terms set forth below.
A “user” is anyone who purchases a product from this Site or visits this Site and relies in any way on any purported instructions, suggestions, or links to other sites that it may provide. To be sure, GDS offers the Site, including all information, tools, and services available from the Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated herein.
By purchasing a product from GDS or following or attempting to follow any instructions or suggestions that may be found on the Site, written, or verbal, the user agrees to be bound by these Terms of Service. These Terms of Service apply to all users of the Site who purchase products and/or rely in any way on any instructions or suggestions as to installation that may be or might become available on the Site. These Terms of Service apply equally to anyone who is a user of the Site, irrespective of whether they are browsers, vendors, customers, merchants, contributors of content, and/or anyone else. Users of the Site who are not purchasers of a product from GDS must also agree to and be bound by these Terms of Service.
GDS sells garage door, parts, openers, and related services. GDS disclaims any obligation or liability with respect to the placement, installment, use, repair, operation, or anything else relating to such parts following the point-of-purchase. Stated otherwise, once the sale of the product(s) is complete, the user or purchaser (including any ultimate end-user) is wholly and exclusively responsible for any injuries or damages that may result from installation, use, placement, or any other operation of the purchased parts. GDS expressly disclaims liability for any bodily injury that may result during the installation, use, repair, or operation of any parts sold.
GDS does not provide authoritative (or any) advice or instruction to users who may happen to visit its website regarding installment, repair, or otherwise regarding the products offered for sale irrespective of whether such users are purchasers or not. Any instructional materials are to be evaluated independently by the person/entity who follows those recommendation(s). GDS does not hold itself out as an instructor to teach others how to install, repair, operate, or manage the parts that it offers for sale. Rather, GDS’s business is exclusively limited to the sale of garage door products. GDS expressly disclaims any liability for damage or injury resulting from installation of any parts sold or advertised on the Site, regardless of any instructional videos, suggestions, or other recommendations that may be made available to any user. Any instructional videos, suggestions, recommendations, or other instructions regarding installation, use, repair, or anything else relating in any way to garage door products are to be followed at the user’s own risk. GDS does not purport to – and expressly disclaims – any liability for damages caused after the point-of purchase. The relationship between GDS and any purchaser is wholly contractual. Once the transaction is complete, so it the relationship between GDS and that purchaser.

We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
In no case shall GDS, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of purchase of any product from GDS or relying on any instruction or suggestion on or recommended by GDS on the Site or otherwise.
You agree to indemnify, defend and hold harmless GDS and any of its affiliates, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.
These Terms of Service will be governed by Georgia law. The user agrees to submit to the venue and jurisdiction of Gwinnett County of Georgia relating to any disputes arising from the purchase of products by GDS or the use of the Site.
